ARTICLE 1 - GENERAL

The buyer acknowledges having read these general conditions of sale (CGV) before placing his order. These General Terms and Conditions apply exclusively to all sales of our products, owned by the company Mindset Decoration, whether for its own account or that of its principals. Any other conditions will only be applicable after written confirmation from us. By placing an order or accepting a sale offer, the buyer accepts these general conditions without reservation. Any condition contrary to our General Terms and Conditions, formulated by the buyer, will be rejected unless we have expressly recognized its applicability in writing. These General Terms and Conditions may be modified at any time and without notice by the company Mindset Decoration, the modifications then being applicable to subsequent orders.

ARTICLE 2 - ORDERS

Orders become effective upon receipt of payment. The customer can request a refund under the conditions of article L 121-20-1. Mindset Decoration undertakes to deliver to the buyer as soon as possible. Except in exceptional circumstances (postal service strike, unforeseen events, etc.), delivery will be made within the deadlines indicated on the website www.mindsetdecoration.com. However, lead times may be longer (for example, during Christmas periods), which the buyer understands and accepts.

ARTICLE 3 - PRICE

The seller's price list does not constitute an offer to sell. It may be modified unilaterally without notice before purchase by the customer. The goods are invoiced at the agreed price at the time of delivery, within the limit of the option period and general economic conditions (taxes, exchange rates, etc.). All prices indicated on the seller's website are net, in euros, all taxes included, excluding transport costs which will be specified before the order is registered by the buyer. Prices may be subject to promotions, sales and other discounts.

We cannot be held responsible to you or any third party for any change in price, or for any modification, suspension or interruption of the Service.

ARTICLE 4 - PAYMENT

All orders must be paid in euros. Full payment of the price must be made at the time of ordering by the buyer. At no time can the amounts paid be considered as deposits or deposits. To pay for their order, the buyer must have a credit card or PayPal account. Payment by card or PayPal is fully secured by the Secret Socket Layer (SSL) protocol, ensuring data encryption to prevent fraudulent use. The order will be shipped upon receipt of payment. The buyer guarantees Mindset Decoration that he has all the necessary authorizations to use the payment method chosen when registering the order. Mindset Decoration reserves the right to suspend or cancel any order and/or delivery in the event of non-payment or payment incident, regardless of their nature and level of execution. Mindset Decoration also reserves the right to request a photocopy of the buyer's identity card and/or proof of address for any order. As part of the fight against Internet fraud, information relating to the order may be checked.

You agree to provide current, complete and accurate purchase and account information for all purchases made in our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

ARTICLE 5 – ARTICLES AND CHOICE OF ARTICLES

All product descriptions and pricing are subject to change at any time, without notice, and at our sole discretion. We reserve the right to discontinue the sale of a product at any time.

The buyer, having read the products and their characteristics marketed by Mindset Decoration, chooses with full responsibility, according to his previously determined needs, the products which are the subject of his order.

ARTICLE 6 - DELIVERY

Delivery time: Your order will be shipped within a maximum of three working days from a partner logistics center, unless otherwise indicated on the product sheet or when finalizing the order. You will then receive a tracking number from our transport provider to be able to track your package.

General rules: The products will be delivered to the address indicated by the buyer when ordering. In the event of absence, a delivery notice will be left in your mailbox, allowing you to reschedule a delivery or collect the products ordered from an establishment of your choice, within the time limit indicated by the carrier on the delivery notice. .

Delivery problems: The buyer is required to check, in the presence of the carrier, the condition of the packaging, contents and functioning of the goods upon delivery. If the buyer has the slightest doubt, he must follow the return procedure (in particular report the damage noted, any complaints and reservations) and refuse the goods by immediately establishing a report of an anomaly with the delivery person. It is necessary to report these incidents within 3 days from the refusal of the goods, stating the complaints or reservations.

Quality or conformity problems: In the event of delivery of a product that does not conform to the order (defective or non-compliant), the buyer must make his complaint within 5 days of signing the distribution slip. Complaints must be sent via the contact form and must include the buyer's contact details, order number, product references and reasons for the complaint. The return procedure will then be communicated. Products returned by the buyer must be returned within a maximum period of 15 working days from the date of delivery or return authorization.

ARTICLE 7 - RESERVATION OF OWNERSHIP

In accordance with the law, ownership of the goods delivered to the buyer will only be transferred after full payment of the price in principal and incidentals, or cashing of accepted checks or other means of payment issued in settlement of the price. During the period from delivery to transfer of ownership, the risks of loss, theft or destruction are the responsibility of the buyer. In the event of non-payment by the buyer, whatever the cause, the seller has the right to demand immediate return of the delivered goods, at the buyer's expense and risk.

ARTICLE 9 - RIGHT OF WITHDRAWAL AND RETURNS

Right to retract :

The French buyer legally benefits from a right of withdrawal of 14 days from the day after the day on which he takes possession of the product. The return costs are his responsibility and the product must be returned within 14 days maximum after withdrawal. This right of withdrawal also applies to sale products sold on www.mindsetdecoration.com.

The refund will be made within 14 days of receipt of the returned product at Mindset Decoration. The buyer must inform Mindset Decoration of their decision to withdraw in advance. This decision must be notified using the contact form. Mindset Decoration will inspect the returned product to verify its condition.

Returns:

The buyer must return the product in its original packaging, unused, with all its accessories, indicating the reason on the invoice.

The buyer can then choose from the following options:
- A new delivery in accordance with the order.
- Repair of the defective product.
- The exchange of the product with another similar one.
- Cancellation of the order and full refund of the price of the returned product.

Returns must be sent to the address indicated by our customer service.

ARTICLE 10 - EXCLUSION OF WARRANTIES AND LIMITATION OF LIABILITY

You expressly agree that your use of the product is at your sole risk.

Mindset Decoration, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers and licensors shall not be liable for any injury, loss, claim, or any direct or indirect damages resulting of your use of one of our products

ARTICLE 11 – COMPENSATION

You agree to indemnify, defend and hold Mindset Decoration and our partners, officers, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees harmless from any claim or demand, including reasonable attorney's fees, issued by any third party due to or as a result of your violation of these Terms of Use or the documents they incorporate, or your violation of any laws or rights of a third party.

ARTICLE 12 – APPLICABLE LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the law
